Donald Kipkorir fallout with Muthaiga Country Club

Kipkorir claims he has been severally denied entry to Muthaiga Country Club, a members-only recreational facility.

In a demand letter by Manyonge Wanyama and Associates law firm, Kipkorir claims that he was invited to a luncheon in the exclusive club in 2022, only to be denied entry on the grounds that another client did not want him to access

Lawyer Peter Wanyama states that his client Kipkorir has been a frequent guest at the Country Club, where he has actively participated in luncheons and meetings upon invitations by his friends and clients who are club members.

"Astonishingly, towards the end of 2022, our client was invited to the club by a member. To his surprise, he was denied entry while attempting to access the premises because another registered member at the facility had raised a complaint against him.

It was only after your intervention that our client was eventually granted access. Further details regarding the occurrence rest well with you," the letter by Wanyama reads.

Wanyama indicated that the 2022 incident was not isolated as his client had several other times been denied access and subjected to immense embarrassment.

"Regrettably, our client informs us this was not an isolated incident. On subsequent occasions, he was denied entry to the club, causing him immense embarrassment and overwhelming distress. These recurrent occurrences have undeniably violated our client's rights as a guest invited by thoughtful members," the demand letter continued.

According to Kipkorir, he was invited to the club by lawyers Peter Wanyama, Grace Sitati, Mercy Munyao, Enith Kyalo and Kurgat Cleophas, who are club members.

He argues that he understands Muthaiga Country Club is a private facility but that only does not grant it the authority to refuse entry of guests unless there is a court order directing the same.

"Our client is aware that the Muthaiga Country Club is a private club and may have rules governing membership or expulsion. Nevertheless, it is imperative to note that the club does not possess the authority to refuse entry to guests unless there is a court order to that effect.

In the instant case, no court order justifies, or even remotely supports, the barring of our client from entry to the club as an invited guest," Kipkorir's lawyer stated.

In the letter addressed to the Muthaiga Country Club Chairman, Philip Coulson, the law firm states that the facility's refusal to allow their client access as an invited guest depicts him as a disrespectful visitor who consistently engages in disruptive behaviour.

Kipkorir observed that in his 25 years of visiting the club, he had never been engaged in disruptive behaviour or gotten drunk.

"Our client's conduct during his numerous visits for the past 25 years has been exemplary. During his visits, he has never engaged in disruptive behaviour, misconduct, or violating the club rules. In addition, our client is not inclined to intoxication, confrontations, or any form of abuse towards others," the law firm stated in the demand letter.

Consequently, Wanyama has demanded immediate and comprehensive disclosure of all details concerning the alleged complaint (s) by Kipkorir and the management to explain the drastic action taken against their client without prior notification of any formal complaint or resolution made against him.

The club has been given five days to heed the demand, failure to which they will proceed to file legal proceedings against the club.
